Terms of Service

1. Acceptance of Terms

By accessing and using the Kohabit platform, you agree to be bound by these terms of service. If you do not agree to these terms, please do not use our service.

2. Service Description

Kohabit is a condo management platform that allows condo boards and owners to manage their documents, communications, votes, and other aspects of daily condo management.

3. Use of Service

You agree to use Kohabit only for lawful purposes and in accordance with these terms. You agree not to:

  • • Use the service in a way that violates applicable laws
  • • Transmit illegal, harmful, or offensive content
  • • Attempt to gain unauthorized access to the service or systems
  • • Use the service to send spam or unsolicited communications

4. User Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

By creating an account, you declare that you are at least 18 years old or have obtained the consent of your legal guardian.

5. Intellectual Property

All content on the Kohabit platform, including but not limited to texts, graphics, logos, and software, is the property of Technologies Kohabit Inc. or its licensors and is protected by intellectual property laws.

6. Limitation of Liability

Kohabit is provided "as is" without warranty of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. To the extent permitted by the laws of the Province of Quebec, Technologies Kohabit Inc. disclaims all liability for direct, indirect, or consequential damages resulting from the use of the service.

7. Modification of Terms

We reserve the right to modify these terms of service at any time. For any substantial change, we will notify you by email with reasonable advance notice before it takes effect. It is your responsibility to regularly review these terms for minor changes.

8. Early Access: Specific Terms

Early access

Kohabit is currently in free early access. By using the service during this period, you accept the following conditions:

  • • Service as-is: The platform is provided without guarantee of continuous availability, performance, or error-free operation. No service level agreement (SLA) is guaranteed during early access.
  • • Data: During early access, maintenance operations or exceptional migrations may require data changes. We will notify you by email with reasonable advance notice before any operation that could affect your data.
  • • Free access: Early access is free. If a pricing model is introduced, you will be notified by email at least 30 days in advance, with the option to export your data or cancel before any billing begins.
  • • Data export: You may request an export of your data at any time by contacting us at [email protected].
  • • Feedback: As an early access user, your active participation (bug reports, suggestions) helps improve the platform. We sincerely thank you for it.

These early access terms take precedence over any conflicting provisions in these general terms during this period.

9. Account Termination & Data Deletion

You may close your account at any time by contacting us at [email protected].

Upon closure, your personal data will be deleted within 30 days, unless a longer retention period is required by law. Data related to condo operations (documents, minutes, etc.) may be retained in accordance with the legal requirements applicable to condo associations.

10. Governing Law & Jurisdiction

These terms of service are governed by the laws of the Province of Quebec and applicable federal Canadian laws. Any dispute arising from the use of the platform shall be subject to the exclusive jurisdiction of the courts of Quebec.
